There are no age restrictions; however:

• The Service may not be used to generate explicit, pornographic, or unlawful material.
• By using the Service, you represent that your use complies with all applicable laws.

We reserve the right to suspend or terminate accounts that violate these Terms.

You may create an account using your name and email address. You are responsible for:

• Maintaining the confidentiality of your account
• All activity under your account

We reserve the right to suspend or terminate accounts at our discretion.

Users may:

• Purchase one-time token packages
• Subscribe for recurring token allocations

Tokens are used to generate images.

If a generation fails due to system error, the token used will be refunded.

Tokens:

• Have no cash value
• Are non-transferable
• Are non-refundable except in cases of technical failure

The Service uses artificial intelligence technology (Google Gemini) to generate images based on user prompts.

You acknowledge and agree:

• AI outputs may be inaccurate.
• We do not guarantee accuracy, authenticity, or factual correctness.
• Outputs may resemble real cruise ships, cruise lines, or brands.
• We do not guarantee non-infringement of third-party rights.

Use of AI-generated images is at your own risk.

You may upload images for generation purposes.

You represent that you have the legal right to upload any content you submit.

If a generated image:

• Does not contain uploaded personal photos, and
• Does not include personal identifying names

It will be stored and displayed in a public gallery.

By using the Service, you consent to this public display. There is no opt-out from public gallery display for eligible images.

We do not display usernames publicly.

Ownership

You receive a non-exclusive license to use the AI-generated image for personal and commercial purposes.

Cruzero LLC retains a non-exclusive, perpetual license to:

• Store
• Display
• Reproduce
• Promote
• Showcase generated images

Trademarks & Cruise Lines

Generated images may include cruise ships, cruise lines, or logos.

Cruzero LLC:

• Is not affiliated with any cruise line.
• Does not claim ownership of third-party trademarks.
• Does not grant rights to use third-party trademarks beyond what may legally apply.

Users are responsible for ensuring their use of generated images does not infringe third-party rights.

You may not use the Service to:

• Generate explicit or pornographic material
• Generate hateful or illegal content
• Violate intellectual property laws
• Resell tokens
• Reverse engineer the platform
• Use the platform to create counterfeit goods

You may print and commercially use generated images, subject to third-party rights.

You agree to indemnify, defend, and hold harmless Cruzero LLC from any claims, damages, liabilities, costs, or legal fees arising from:

• Your generated content
• Your misuse of trademarks
• Your violation of intellectual property rights
• Your breach of these Terms

If your generated content results in legal action against us, you agree to cover our legal costs and defense.

To the maximum extent permitted by law:

Example: If 1 token was used, liability is limited to the price paid for that 1 token under your plan.

We are not liable for:

• Indirect damages
• Lost profits
• Business interruption
• Trademark disputes
• AI inaccuracies

The Service is provided “AS IS” and “AS AVAILABLE.”

We disclaim all warranties including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy

Any dispute arising under these Terms shall be resolved through binding arbitration in Wyoming, USA.

You agree:

• No class actions
• No jury trials
• Disputes must be brought individually

This provision survives termination of these Terms.

These Terms are governed by the laws of the State of Wyoming, United States.

We may suspend or terminate accounts at our discretion.

If you believe content on cruise.photos infringes your copyright, submit a notice including:

• Your contact information
• Description of copyrighted work
• URL of infringing material
• Statement of good faith belief
• Statement under penalty of perjury
